Ontario requests feedback for changes to Condo Act

The Ministry of Public and Business Service Delivery and Procurement is looking for feedback from the condo industry related to potential changes to the Condo Act.

There are sections of the Act that the Ontario government passed in 2015, which never formally became law. They include strengthening protections for condo owners and purchasers by improving transparency and clarity while limiting burden.

These sections of the Protecting Condominium Owners Act, 2015 (PCOA) would amend sections in the Act related to: status certificates; disclosure statements; cancellation of purchase agreements (material changes); developer turnover meetings; condo performance audits; and waiving remedies against developers.

The ministry is also exploring the development of regulations under the Condo Act that would support the proclamation of these PCOA provisions, while considering potential changes related to proxy forms records access (to increase condo safety).

The ministry is looking for feedback through a survey link by October 27, 2024, to examine associated regulatory impacts should specific regulatory changes be proposed.
